VACATION RENTAL TERMS AND CONDITIONS
Upon booking this accommodation, the following General Conditions will come into effect, governing the seasonal rental contract between you and the property (Fco Javier Ruiz Rubio), through our real estate agents.eserva del alojamiento entrarán en vigor las siguientes Condiciones Generales que regirán el contrato de alquiler de alojamiento de temporada entre Usted y la propiedad (Fco Javier Ruiz Rubio), con la intermediación nuestros agentes inmobiliarios.
1- PAYMENT AND CONTRACTING CONDITIONS
You can make your reservation by phone, by email, through our websites, or directly through our real estate agents.
Your reservation will be confirmed upon receipt of the correctly completed reservation form and payment. By making the initial payment, the client/tenant declares that they have read and understood the owner’s general conditions, through our agents.
The property, through our agents, reserves the right to cancel the reservation if payment has not been received within 3 days of submitting the reservation form or if the validity of the credit card has not been verified. In cases where a reservation is made less than 3 days before the start of the reserved stay, payment must be made immediately.
TOTAL BILL PAYMENT: Depending on the payment method chosen, the outstanding amount must be paid at check-in by credit card (Visa or Mastercard) or cash in local currency, except for offers that have their own terms. Non-refundable: 100% payment will be due at the time of booking.
2-PAYMENT METHODS
By bank transfer, sending proof of payment by email. (It may take several days for payment to be verified.)
Through the website via secure payment through STRIPE using a credit card (immediate payment). Through PayPal (immediate payment) and leaving the credit card details as a guarantee.
– The property, through our agents, reserves the right to cancel the reservation without prior notice if the full amount has not been received by the specified dates. In this case, the client/tenant may not claim or demand compliance with the reservation or a refund of amounts already paid. In the event of overbooking, the property also reserves the right to cancel the reservation.
3- PRICES
– Published prices include VAT and are subject to change without prior notice.
ENTRIES AND EXITS
Check-in is mandatory between 4 and 6 PM, and check-out is mandatory before 11 AM. If you are unable to occupy the accommodation on the day of arrival or at the key collection time due to any travel difficulties or personal reasons, or if you shorten your stay, our agents or the owner will not issue any refund. Whenever possible, you will be allowed to check in early or check out late, by prior arrangement with the property owner or the intermediary.
CANCELLATION OF THE CONTRACT BY THE CUSTOMER AND RETURN
The client has the right to cancel the reservation under the following conditions:
The client agrees to respect reasonable housekeeping rules; therefore, parties and noise are not permitted in accordance with current legislation. The company reserves the right to cancel the reservation in the event of unrest among other guests or neighbors.
The reservation may be canceled free of charge up to 5 days before check-in.
For reservations of more than 25 days, you have 14 days to cancel free of charge.
If the state of emergency is reinstated or any force majeure occurs, you may cancel at any time before arrival. You will only be required to pay the financial charges, which are 5% of the total payment.
If you decide to vacate before the originally booked date, unused time will not be refunded.
If the client has booked through a partner agency or website external to VISTAMAR BEACH LUXURY, they will be subject to the cancellation policy of said agency or external website. VISTAMAR BEACH LUXURY will not be responsible for any cancellation charges.
It is strongly recommended that clients purchase travel cancellation insurance. Any cancellation, including force majeure, will be subject to our clear and simple cancellation policy as stated here.
In cases of force majeure or unforeseen inability of the property to accommodate the client (geological or terrestrial conditions, lightning, flooding, etc.), our agents and the owner will offer the client the option (when possible) of replacing the accommodation with another of similar characteristics or canceling the contract with a refund for the period following the unforeseen inability to accommodate.
All cancellations or changes must be made in writing via email to daruvistamar@gmail.com or by writing to one of our real estate agents.
6- IDENTITY OF THE GUESTS
At the time of booking, you must provide the property or any of our agents with your full name, phone number, and email address. You must also provide the number of people who will be occupying the apartment during your stay. All adults in your party must show identification at or before check-in, and only members of your party will be using the apartment.
7. CUSTOMER OBLIGATIONS
Accommodation occupancy will be limited to the number of people indicated in the contract, including children and infants. The owner or key manager may refuse entry to the accommodation if the permitted number is exceeded. If the tenant exceeds this capacity, they will incur an additional charge of €50 per night and may be evicted. Smoking is not permitted, only on the terrace. Pets are also not allowed.
A security deposit to be determined upon arrival at the accommodation will be required, payable in cash or by credit card. It is not applied to the rent. It will be returned by bank transfer, cash, or deposit into an account, after an inspection of the property within a maximum of 7 days from the date of departure, provided the following conditions are met:
- There is no damage to the property or contents.
- There are no charges for illegal activity, pets, or fines for the tenant.
- All waste and trash are collected in the trash receptacle.
- All keys/electric gate remotes are placed on the kitchen table/countertop and the property is left locked.
- All rental charges are paid prior to departure.
- Sheets and towels are undamaged.
- There is no late check-in or check-out.
- Garage remotes and electrical appliances are left inside the property.
- If the tenant is to be evicted by the owner or police.
If the tenant causes damage to the property exceeding the deposit paid, they must pay the difference without delay upon receiving the full amount of the damages in writing from the Property, through our agents.
The tenant/client is obliged to leave the property in a tidy and presentable condition. This includes (but is not limited to) ensuring that dishes are clean and in their proper place, the refrigerator is free of food residue, and the trash is emptied. If this is found to be a breach of contract, an additional fee may be charged for the final cleaning of the apartment.
The tenant must respect the neighbors and the rules of the Owners’ Association to which the accommodation belongs. In the event of negligence or inappropriate behavior, the Property Owner, through the intermediation of our agents, reserves the right to cancel the rental agreement with immediate effect and without prior notice. In this case, there is no obligation to refund the rent paid by the client.
The final or departure cleaning fee must be paid by the client/tenant and can range between €30 and €40 unless included in the initial price and so indicated.
We suggest bringing beach towels, as house towels cannot be taken outside.
8- MINIMUM STAY
– Depending on the season, this fee can range from 3 days to 7 days, unless otherwise agreed.
9- INCLUSIVE FEES
The rate includes the following:
– A set of sheets and towels upon arrival
– Water and electricity are included unless the daily usage exceeds 10 kW/day. Beyond this amount, an additional charge of 0.30 ct/kilowatt will be applied.
10-FALSE RESERVATIONS
Any reservation obtained with false information will be subject to charges, and the rental period cannot be guaranteed.
11- WRITTEN EXCEPTIONS
Any exceptions must be communicated in writing.
13- COMPLAINTS
Complaint forms are available to guests.
14- LIABILITIES
The property, through our agents, assumes no liability in the following cases:
- Negligence or omission of services attributable to third parties, such as physical damage, loss due to theft, fire, or criminal conduct.
2- Failure or improper operation of swimming pools, children’s play areas, and sports facilities of any kind, with use of these remaining strictly under the user responsibility.
- External circumstances surrounding the rented accommodation, such as noise, odors, neighbors, pests, etc. The toilet may emit odors. DO NOT FLUSH anything other than toilet paper. Do not flush sanitary pads down the toilet, as this could cause a blockage and the unblocking charge could reach €200.
- Damage to persons or property caused by force majeure or unforeseen events for which neither our agents nor the owner are responsible.
15.-VALIDITY AND JURISDICTION
Upon booking an accommodation, the above general conditions will come into effect and will govern the seasonal accommodation rental contract between you and the Property or our agents, who act as intermediaries between the tenant and the owner of the accommodation and are responsible for the proper execution of the mediation, which is carried out in accordance with current laws. These general conditions and the contract between you and the Property will be governed, interpreted, and enforced in accordance with Spanish law, and you will submit to the courts of Vélez Málaga (Málaga), expressly waiving any other jurisdiction.
